This Privacy Policy describes how we collect, use, disclose, and safeguard your personal information when you visit our website, submit a contact form, or communicate with us by phone, text message (SMS/MMS), or email.

By using our website or submitting your information through our contact form, you agree to the terms of this Privacy Policy. If you do not agree, please do not use our services or submit your information.

2. Information We Collect

We may collect the following categories of personal information:

Information You Provide Directly: When you submit our contact form, we collect your full name, phone number, email address, approximate date of your accident, and a brief description of your situation. We may also collect any additional information you choose to share during a phone call or other communication with us.

Automatically Collected Information: When you visit our website, we may automatically collect your IP address, browser type and version, operating system, referring URL, pages visited, date and time of your visit, and other standard web analytics data.

Phone and Communication Records: If you consent to receiving calls or text messages, we may collect call recordings (with disclosure), call duration, text message content, and timestamps of communications. Calls with our AI assistant are recorded and you will be informed of this at the beginning of the call.

3. How We Use Your Information

We use the information we collect for the following purposes:

To contact you by phone, text message (SMS/MMS), or email regarding the accident claim inquiry you submitted; to connect you with qualified legal professionals who may be able to assist with your case; to evaluate and process your inquiry; to improve our services and website functionality; to comply with legal obligations; and to maintain records of consent and communications as required by applicable law.

4. Consent to Be Contacted (TCPA Disclosure)

By submitting your information through our contact form, you provide your express written consent to be contacted by Case Flow, its agents, affiliates, and/or partner law firms at the phone number and/or email address you provided. This contact may include:

Phone calls, including calls made using an automatic telephone dialing system (ATDS) or artificial/prerecorded voice technology, including AI-powered voice assistants; text messages (SMS/MMS), including messages sent via automated systems; and emails related to your inquiry.

You understand and agree that this consent is not a condition of purchasing any goods or services. Standard message and data rates may apply to text messages. You may receive up to 10 messages per month related to your inquiry. Message frequency may vary.

You may revoke your consent at any time by replying STOP to any text message you receive from us, by calling us and requesting to be removed, or by emailing us at privacy@thecaseflow.com. Upon receiving your opt-out request, we will cease the specified communications within a reasonable time frame, typically within 10 business days.

5. How We Share Your Information

We may share your personal information with the following categories of third parties:

Partner Law Firms: We may share your contact information and inquiry details with qualified personal injury attorneys or law firms who may be able to assist with your case. These firms are independent entities and their use of your information is governed by their own privacy policies.

Service Providers: We use third-party service providers for website hosting, analytics, communication platforms (including AI voice and SMS services), and customer relationship management. These providers are contractually obligated to use your information only to perform services on our behalf.

Legal Requirements: We may disclose your information when required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

We do not sell your personal information to third parties for their direct marketing purposes.

6. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Consent records (including records of your opt-in to receive calls and text messages) are retained for a minimum of five (5) years in compliance with TCPA and TCR requirements. Call recordings and communication logs are retained for the duration required by applicable regulations.

7. Data Security

We implement reasonable administrative, technical, and physical security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit (TLS/SSL), access controls, and regular security assessments. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
